TENANT AGREEMENT -

ELECTRONIC RENT PAYMENT SERVICE

EXCLUSIVE REGISTRATION SERVICE


Tenant Plus, Inc. (“TP”) currently provides access to an Internet-based electronic payment service for monthly rents, periodic rents, security deposits, other deposits, condo fees, timeshare charges, fixed utility payments, other fixed payments and all other fees and charges related to leased space, fixed or variable (the "Electronic Rent Payment Service"). The Electronic Rent Payment Services are offered via credit card, on-line electronic checking, or pay-by-phone payment options. This Service is offered in order to facilitate electronic transactions between property owners or property managers (“Owner/Manager”) and their respective tenants. The other service is the “Exclusive Registration” which provides the tenant the ability to view all property contact information from both public and private listed properties. The “Basic Registration” at no charge offers only the contact information visible from properties listed as public listings.

 

You, as the tenant of a participating Owner/Manager, are eligible to use the Electronic Rent Payment Service to pay your rent and any related fees covered under our separate service agreement with your Owner/Manager. Your credit card, on-line electronic checking, or pay-by-phone payments made through our Electronic Rent Service will be remitted to your Owner/Manager in accordance with Tenant Plus’ Electronic Service Agreement with such Owner/Manager. Once you have agreed to Tenant Plus’ Terms & Conditions, you will choose a unique Tenant User I.D. and be assigned a Password which will be matched in our database with your unit. Once assigned an I.D. and Password, you may begin paying your rent electronically. Some Owner/Manager’s may not offer the credit card payment option. Please contact TP in order to verify whether your Owner/Manager offers such an option. Begin the process now by carefully reading the following Terms & Conditions. “Exclusive Registration” can be paid via credit card, debit card, or e-check and will be good for a two week period from the date of purchase.

 

Tenant Plus, a.k.a. tenantplus.com, hereinafter referred to as “TP,” and you, as a Tenant Plus Member, hereinafter referred to as “TENANT,” hereby agree as follows:

1.     TENANT acknowledges that he/she has used the TP website for the purposes of facilitating rent and other related transactions electronically.

 

2.     TENANT understands and agrees that TP is not and has not represented that it is a Real Estate Brokerage.

 

3.     TENANT further acknowledges that TP is not acting in that capacity on behalf of the TENANT or Owner/Manager in connection with the electronic payments or exclusive registration. Any action taken by TP on behalf of the TENANT is and will be within the course and scope of TP’s Electronic Transaction Service for accepting TENANT’S rent payments electronically; verifying its authenticity; and subsequently remitting payment to TENANT’S Owner/Manager.TENANT’S electronic payment will be processed in compliance with all privacy laws and confidentiality protections for all TENANT’S and in full compliance with all fair housing requirements of all Governing authorities in Federal State and Local jurisdictions.

 

4. TENANT will choose a User I.D. and be assigned a Password when completing the sign up process for the Service. You are solely responsible for maintaining the confidentiality of your I.D. and Password, and are fully responsible for all activities occurring under your password or account. You agree to notify TP immediately if you notice unauthorized use of your password or account or any other breach of security. TP cannot and will not be liable for any damage or loss arising from your failure to comply with this Section.

 

5. TENANT agrees to: (i) provide information about yourself that is true, accurate, current and complete as prompted by the Service's sign up form (the "Sign up Information") and (ii) where applicable and appropriate, maintain and promptly update the Sign up Information to keep it true, accurate, current and complete. If you provide information that is untrue, inaccurate, not current or complete, or if TP, has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, TP, reserves the right to suspend or terminate your TP, account and refuse any and all current or future use of the Service. You may not use the Service for any illegal purpose or in any manner inconsistent with the terms and conditions of service.

 

6.    TENANT agrees to sign and execute any and all papers, documents, and verifications required in order to effectuate this Agreement and its intended purpose.

 

7.    TENANT hereby acknowledges that TP has made no guarantee of any kind with regard to the obligations of the Owner/Manager to TENANT under the lease as well as with the accuracy of the contact information listed on properties posted on the TP site.

 

8. TP, reserves the right at any time to charge and/or increase fees for access to portions of the Service or the Service as a whole. In no event will you be charged for access to portions of the Service or to the Service unless TP obtains your prior consent to pay such charges. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including but not limited to charges for any services offered through the Service by TP, or by any other vendor or service provider. You shall pay all applicable taxes relating to the use of the Service through your account, and the purchase of any other services. Late fees may be assessed for rent payments made by credit card, on-line electronic checking or pay-by-phone media, which occur after the late dates and or grace periods as established in our agreements with Participating Affiliates. [Certain portions of the Service or the Service as a whole may require a prepaid fee ("Prepaid Fee"). You will pay the Prepaid Fee, and all taxes and other fees related thereto, in advance. In no event will you receive any portions of the Service or the Service as a whole if a Prepaid Fee is required unless TP receives all fees and charges payable by you, including the Prepaid Fee.]

 

  • Tenant acknowledges that TP is responsible solely for processing the electronic transactions that the TENANT initiates and does not hold itself out as a collection agency. TENANT understands that TP will supply both Owner/Manager and TENANT with a timely electronic confirmation via email acknowledging that a particular transaction has been received by TP and posted to Owner/Manager’s Billing History. If such notification is not received, TP makes no guarantee that the transaction was ever received by TP or that payment was ever posted to Owner/Manager’s Billing History. Absent an email confirmation of receipt, it is solely the responsibility of the TENANT to ensure that their payment has been properly received by the Owner/Manager. Additionally, it is the TENANT’s responsibility to ensure that such transactions are received by Owner/Manager in a timely basis according to the terms of the separate lease/rent agreement executed between the TENANT and Owner/Manager. Any dispute between the OWNER/MANAGER and TENANT regarding amount of payment, timing of payment, lack of payment, late-charges incurred, overdue rent and the like will be handled exclusively between Owner/Manager and the TENANT. TP is merely providing an electronic rent transaction service to facilitate rent payments between TENANT and Owner/Manager.

 

  • For all electronic transactions that are returned by the TENANT’s bank due to Non-Sufficient Funds (NSF) or for any other reason(s), TP will charge a NSF equal to Twenty-Five Dollars ($25.00) for each such declined request. TENANT will be responsible for these fees, and the TENANT hereby authorizes TP to take all necessary steps to recover any such fees from the TENANT, including but not limited to, directly debiting TENANT’S bank account or charging their Credit Card for the amount due plus any associated transaction fees.

 

11. TP agrees to provide TENANT with electronic copies of any and all forms that such TENANT may reasonably request regarding any disputed transactions from TENANTS account.

 

12. TENANT further acknowledges that TP in regards to the “Exclusive Registration” of viewing all property contact information for listings posted on the TP site as either confirmed or unconfirmed vacancies will not provide payments back if TENANT is unsatisfied with outcome of results. With research of TENANT request by TP and pending outcome of research a possible extension will be provided to TENANT due to reasonable results of unsatisfactory of “Exclusive Registration.”

 

13. Either TENANT or TP may cancel use of the Service with or without cause at any time and effective immediately. You may cancel the Service by calling TP or by sending an e-mail to [customerservice@tenantplus.com] to request discontinuance of the Service and destroying all materials obtained from the Service. You will remain liable for all outstanding payments and fees due at the time of cancellation. TP may terminate the Service immediately without notice if you, in TP’s sole discretion, fail to comply with any provision of these terms and conditions of service.

 

  • TENANT further acknowledges that TP has made no representation of any kind to the TENANT other than set out in this agreement.

 

  • TENANT further acknowledges that TP has made no representation that with the “Exclusive Registration” the properties referred to as private listing be vacant at the time of the date of registration and or time of subscription to the service.

 

  • For payments you believe were improperly made, TP may, in its sole discretion, void, rescind or issue a credit for your rent payment made through the Service at any time prior to the remittance of such rent payment to your Owner/Manager. If a rent payment dispute arises after payment is forwarded to your Owner/Manager, the responsibility to settle the rent payment dispute rests with you and the Owner/Manager. You waive the right to cancel credit card payments, which have been cleared through TP clearing entity.

 

  • TENANT understands that by clicking on the “I Agree to Terms and Conditions of Tenant Plus” check box the TENANT is signing the record in an electronic form in order to enter into a legally binding agreement with Tenant Plus for the services rendered under this Agreement. TENANT further understands that such a signature of acceptance is the electronic and legal equivalent of a manually scripted signature. Therefore, once the record is signed, any continued use of the services offered at tenantplus.com by TENANT will be conducted according to this Agreement.

 

By clicking the "I Agree to Terms and Conditions of Tenant Plus" check box you represent and warrant that you have read, acknowledge and agree to be bound by the terms and conditions of the TP service. You further represent and agree that: (i) you have the power and authority to enter into this agreement; (ii) you are at least eighteen (18) years old; (iii) you will comply with all US law regarding the transmission of any data obtained from the Service in accordance with the terms and conditions of service; (iv) you will not use the Service for illegal purposes, and (v) you will not interfere or disrupt networks connected to the Service.
